Sure, go get married in Indonesia. If her VISA is expired, she will probably be arrested if she shows up at a US government courthouse to get married.

Marriage is a civil matter. Whatever identification the marriage license bureau wants to accept, they'll accept. If a foreign passport meets their requirements, they'll give you a marriage license.

Fred S is perfectly correct. Marriage is a civil matter, and it depends on your location whet the authorities require before you can be married. However, getting married will not change her status.She will still be illegal, and you cannot rectify that.While she is illegal,she can never get a decent paying job, and sooner or later, she will be deteced as an illegal and deported.If that happens it will be years before you can get her back into the US. Do did not mention if you met her in Indonesia, or in the US, or how she got into the US in th first place. If you met her in the US, you should ask yourself if her reason for wanting to marry is because she thinks it is a way to legalise her in the US. You should explain to her that it cannot. If you really want to marry her, and she really wants to marry you, by far the best thing to do is to send her home,then apply properly for her to come to the US as your fiancee, or if you have already married, as your spouse. Then everything will be legal and you will not be forever looking over your shoulder for wondering if the next guy is the one that is coming for her. If she is genuine, you will not have any difficulty getting her back into the US. It will just take a while, but you can put up with that if you really want to be together. The longer you put it off, the worse it will be.If you marry now, you may at sometime be charges with aiding and abetting an illegal, which is a crime. If she is charged with something that might bar her from returning. That is all bad. Help her, and help yourself. Send her back home, and then get her back legally.If she leaves voluntarily that will be good for applying to come back to the US. One tip. Don't bother trying to get ne of those so-called immigration lawyers to 'help' you.They will just help THEMSELVES with as much of your money as they can get hold of, by keeping you on the hook as long as possible.
